Summary/Abstract: The author analyzes the status of the electoral rights in the European Union, rights derived from the European citizenship. Instituted under article 8 of the Treaty of Maastricht, the European citizenship was given shape and defined by a series of later documents. Thus, the Charter of Fundamental Rights introduces new clarifications related to the rights of the European citizen, particularly the political ones, with emphasis on his relationship with the public structures of the European governance. Modified in comparison to the constitutive treaties, the Treaty of Lisbon will stand for the birth certificate of a European electoral corpus. The author devoted ample space to the Code of good practices in terms of electoral issues and the Code of good practices in terms of referendums, in the context of the relationship between the Community Law and the human rights treaties adopted by the Council of Europe. Finally, she presents the conditions for the extension of the right to vote and to be elected in the framework of the municipal and the European elections within the European Union.
