Summary/Abstract: In the period of major economic crisis mankind has been experiencing at global level for the last several years, when the Millennium Objectives cannot be achieved and quarter of world's population and 17% of Europe's population are living in extreme poverty, the author considers that economic, social and cultural rights need continue to be given particular attention. The analysis is focused on the evolution of social rights within the system of European law, on the position of social rights in the European Community and the European Union, as well as the social rights and the guarantees included in the Charter of fundamental Rights of the European Union. And last but not least, she considers that it is important to be familiar with the national legislation of the European Union member States in terms of the provisions related to the social guarantees included in the Charter and the concordance or the discrepancies among them. It is noteworthy that the protection of social rights was improved once the Charter of fundamental Rights of the European Union had been adopted, the latter being a legal normative text that consecrates in one single document, at the Union's level, the civil and political rights and the economic, social and cultural rights, as well as third generation rights.
