Summary/Abstract: The versatile nature of the concept named ‘error’ affects the validity and legitimacy of the human behaviors from the legal point of view. The study case illustrates the individual’s right for pecuniary compensation from the state for suffered damages as a result of a conviction or an unjust preventive measure and comments on both national legislation and jurisprudence and also on the inconsistent practice of ECHR.
