Summary/Abstract: The characterisation in European Private International Law is a component of the interpretation of European Law by the Court of Justice of the European Union (CJEU). Starting from a case recently decided by the CJEU (C-59/19), in the first part of the paper at hand are clarified the notion of characterisation and the role of the CJEU in interpreting/characterising the European Law (1). In the second part, an analysis of the CJEU decision is made. Although the characterisation concerns a cessation claim for anti-competitive practices, it has indirect effects on the unfair terms in adhesion contracts concluded between professionals (2).
