Summary/Abstract: German Federal Constitutional Court (hereinafter: FCC) is famous for its effective competencies and constitutional interpretation according to the current political affairs within the legal framework. Nevertheless, the formation of the Court is not consistent with the international recommendation of judicial independence because of the Federal Constitutional Court, Federalism, Separation of Powers, Selection of Judges, Judicial independence. Judges cannot participate in the appointment procedure even under the Basic Law, 1949. Just the legislature; Bundestag and Bundesrat select the judges and the federal president appoints appoint them. Therefore, this research explores why the judges cannot take part in the appointment process of the members of the FCC and how it is reasonable under German constitutionalism.
