Summary/Abstract: Within the evolution of human society more and more human needs have taken shape. However, regardless of the period in which we lived in, man has always sought to satisfy at least two needs: food and housing. The need for a home is in a close connection with the existence of a family. We can say that having a family depends on the existence of family homes. If until recently, the notion of „family home” was a doctrinal notion, we see that the current Civil Code expressly states the institution of the family home. In its case-law, the European Court of Human Rights gave an autonomous interpretation of the notion of family, family-home and home.
