Remuneration for establishing the easement of the necessary path in the light of judicial decisions

Summary/Abstract: Judicial practice abounds in numerous disputes arising from the provisions of land ease-ments. It can be said that there are many interesting legal issues in both doctrine and juri-sprudence, which would certainly require separate and detailed studies. First of all, the issue of remuneration due to the owner of encumbered easement is widely discussed. The regula-tions do not indicate criteria leading to determining the amount of remuneration, which rai-ses many doubts in practice. The presented article is devoted to discussing the method of determining the amount of remuneration for establishing a necessary easement. Its purpose is to present various proposals for ancillary criteria that should be taken into account when calculating the payable due to the property owner.
