Summary/Abstract: In its judgment of 11 October 2016, the Constitutional Tribunal found that the administrative provisions did not provide for any exceptions to the mandatory suspension of a driving license due to exceeding the speed limit by more than 50 km/h in residential areas. The Constitutional Tribunal indicated that a police officer or local authority, as well as the authority supervising the legitimacy of a decision-making process, should be able to take into account the state of higher necessity and the possibility of waiving the imposition of an administrative penalty in the form of suspension of a driving license. However, the provisions adopted later by the Parliament do not implement the judgment of the Tribunal. The possibility of withdrawing from the driving license suspension is taken too narrowly and in such a way that these provisions will never find practical application in everyday life.
