Summary/Abstract: With regard to continuous legal uncertainty in the field of software patenting in Europe it is appropriate to evaluate development and current situation of protecting software as a basic structural element and a structural tool of cyberspace. The question does not stand whether to adopt a unifying European regulation, but rather what should this regulation be like in the context of understanding software and patents, what should be its significance in further research and development of computer programs, and last but not least, what effect can it have on innovation of software industry.
