Summary/Abstract: The article presents problems arising from the amendment to the Penal Code regarding the extension of the borders of defence of necessity. The amendment is aimed at limiting the criminal liability of the victim defending himself or herself against the assailant when the attack takes place in his or her place of residence. The article presents the reasons for the application of the introduction of this new provision, discusses it and points out the doubts that may arise in its context.
