Summary/Abstract: According to Directive 1999/44/EC on certain aspects of the sale of consumer goods and associated guarantees, the seller is liable to the consumer for any lack of conformity which exists at the time the goods were delivered. The conformity with the contract derives not only from conformity with the express terms of the contract, but also from conformity with certain criteria laid down by the directive, criteria which in continental legal systems may be considered as imperative rules applicable to contracts governing the sale of consumer goods. As such, this short paper discusses some aspects of the lack of conformity which became apparent within six months of delivery of the goods and the conformity criteria provided by Directive 1999/44/EC.
