Summary/Abstract: The commentary concerns the judgment of the Court of Justice of the European Union issued as a result of the Irish court's question regarding the possibility of suspending the execution of the European arrest warrant. This question was raised in connection with doubts regarding the guarantees of a fair trial in Poland, which were formulated on the basis of changes in the organization of the Polish judiciary in 2015-2018 that were contrary to the rule of law. The commentary closely analyses the principle of trust between the Member States of the European Union, as well as determines the position of the fundamental rights in relation to the values such as the principle of automaticity and the principle of resolution of a criminal case within a reasonable time in proceedings for the execution of a European arrest warrant. The necessity of examining in each case whether a given person may be exposed to an unfair trial in the face of systemic irregularities in the functioning of courts is questioned.
