Summary/Abstract: The present study aims to highlight the distinction between the military command act and the normative administrative act issued for the application of the state of emergency / removal of the consequences of epidemics. Moreover, the author develops some clarifications regarding the possibility of attacking before the administrative contentious court the military ordinances issued by the Ministry of Internal Affairs during the pandemic caused by COVID 19.
