PRACTICAL ASPECTS REGARDING THE INSTRUMENTATION OF CAPITAL MARKET OFFENSES

Summary/Abstract: Since the risks and vulnerabilities identified by the legislature when drafting normative act regulating the capital market does not cover the whole range of hazards that may affect the creation and development of the capital market, we identified risks and vulnerabilities in this area by addressing them on three levels (legislative institutional and procedural), so that proposals for solving the problems they raise to circumscribe the same criteria approach. In this paper we describe how to carry out an investigation conducted in reference to fraud that can be committed in the capital market.
