Summary/Abstract: The study refers to the ways of court referral, conditions provided by law for the validity of the indictment, and in criminal cases in which solutionof restitution may be ordered to restore lost document instituting the proceedings. The analysis took into account the current criminal procedure law and the new code of criminal procedure, expected to come into force in 2014.
