CONNECTING THE PREVENTION OF CRIME EXPRESSED BY APPLICATION OF THE FORCE TO THE PROCEEDINGS IN UKRAINE

Summary/Abstract: In the article on the basis of the analysis of scientific literature, the essence and content of activities connected with the prevention of crimes committed by the personnel of the penitentiary institutions in connection with the use of force against the convicts are determined, as well as the main problems that arise in this way are determined. , and formulated scientifically substantiated proposals for their substantive resolution. As practice shows, in the structure of crimes committed by the personnel of the penitentiary institutions of Ukraine, a significant place is occupied by those related to the use of force against the convicted persons. In particular, only in 2016, the share of these crimes in the total number was 7%. The essence of this problem lies not only in the fact that in this way the staff of the penitentiary institutions undermined the authority of the state authorities and encroached on the administration of justice in Ukraine, but it also manifests itself in the ineffectiveness of the activities related to the prevention of crimes committed by the said persons in the field of execution of sentences. In turn, one of the conditions conducive to such a state of preventive activity is the low level of theoretical and practical knowledge related to the essence and content of the prevention of crimes involving the personnel of penitentiary institutions. Consequently, there is a complex application problem that needs to be solved, including at the doctrinal level.
