The robbing of a corpse, a grave or another resting place of the deceased (contemporary scope of criminalization and degree of punitiveness in Polish and German-language law)

Summary/Abstract: The crime of robbing a corpse, a grave or another resting place of the deceased (Article 262 § 2 of the Polish Criminal Code) is often the subject of analysis of contemporary specialists in criminal law. This publication goes beyond the discussion of the objective and subjective elements constituting the abovementioned crime, seeking answers to the justification of this criminalization and also elaborating on its deficiencies and deficiencies in penal response to this crime. The authors confront their observations with analogous regulations in force in Germany, Austria, and Switzerland.
