Summary/Abstract: At a side of the debate on intellectual and industrial rights are those who advocate that these rights are developed as a result of the special abilities and work of individuals and therefore that these rights are protected, while at other side of the debate are those who advocate that information is public, that information production is not possible without societal memory, and that historically the origin of this debate is identical to the history of property rights, and the debate has not lost its place on the agenda. In this study, theoretical approaches to justifying property rights and especially intellectual property rights are discussed and examined. In this context, theories about justifying patent protection will be discussed first. Then, how the concept of ownership, which is the origin of the debate, is defended and criticized in the literature will be examined in connection with intellectual property rights.
