Summary/Abstract: There are several provisions of the Civil Code whose legal dogmatic significance is not in doubt. One of these provisions is § 415 of the Civil Code (hereinafter referred to as the Trademark Law). According to the general opinion, this provision contains a general preventive obligation to prevent damage. Violation of this obligation, according to the prevailing doctrine, results in the illegality of the act. According to the prevailing doctrine, § 415 of the Civil Code is thus the basis for the emergence of legal obligations that exist beyond the obligations imposed by special regulations. In relation to other prevention standards, § 415 of the Civil Code has the form of a so-called general clause.
