Remand in cases of (not only) juvenile persons in the perspective of the new legal regulation

Summary/Abstract: The commentary to the Criminal Procedure Code states that the purpose of detention is to secure the person of the offender for criminal proceedings, so that it is possible to obtain a proper identification of criminal offenses and punish their perpetrators fairly in accordance with the law. It is well known that the institution of detention of a juvenile is understood as a means of securing his or her person and should be applied only if other means of replacement are not possible. The reason for such a concept is the well-known fact that the bond itself does not have a primarily educational effect and its imposition should therefore be kept to a minimum. Research and practical experience even consider the juvenile's stay in a prison as a criminogenic factor.
