Summary/Abstract: The franchise agreement is based on the principle of freedom of contract and is the result of adjusting legal turnover to the needs of entrepreneurs in a constantly evolving economic environment. Due to the fact that Polish law does not regulate the franchise agreement and there are no legal regulations that would apply directly to it, the question arises as to what regulations this legal relationship is subject to. The franchise agreement is a complex structure. This problem becomes even more evident when one takes into account the significant similarity of the franchise agreement to other commercial or civil law agreements (including agreements concerning intellectual property rights). The franchise agreement shows a number of features of different agreements and combines these features, creating a new form of cooperation between entrepreneurs. The article indicates the differences and similarities of the franchising agreement to the patent licence agreement, the trademark licence agreement and the know-how agreement.
