Some considerations regarding the theoretical and practical effects of the amendments to law no. 448/2006 on the protection and promotion of the rights of people with disabilities through o.u.g no. 60/2017

Summary/Abstract: The scientific approach aims at analyzing the most important amendments to Law no. 448/2006 on the protection and promotion of the rights of people with disabilities by the provisions of OUG no. 60/2017. The changes will be interpreted in terms of their effects on stimulating the social inclusion through work of a disadvantaged social category, namely that of people with disabilities. The next text of art. 78 paragraph 3 of the Law no. 448/2006, in conjunction with the implementation deadline of 1 September 2017 and the obligation stipulated for all employers with more than 50 employees, both private and public sectors, generates practical effects which causes analysis and interpretation.The study ends with a series of lege ferenda proposals, considered in the author's opinion to be necessary for the real stimulation of employers to employ people with disabilities rather than imposing obligations on them in the form of constraints. Thus, it is considered that only through such social policies, disadvantaged categories, such as disabled people, can be supported in order to limit or even eliminate their risk of social exclusion.
