Summary/Abstract: During this art has been described obligation to guarantee against eviction institution as regulated in the New Civil Code. Recent legislative changes have been exposed and argued for a better understanding of the will of the legislature. Presentation followed its important aspects, such as the New Civil Code regulations, cases of warranty against eviction, eviction total and partial, Conventional security and prescription. Addressing this theme covered the innovations presented in the New Civil Code, including: the seller's obligation to guarantee against eviction and acquirers of subsequent of the property, whether the property has been sent free of charge or for consideration, remedies for eviction total or partial.
