A comparison of legal means for the defense of private property right and other real rights

Summary/Abstract: This paper examines the legal means to protect real rights in general and the right to private property in particular in relation to old and new civil settlement. Without proceeding to a detailed theoretical analysis, I have outlined below the consecration of constitutional and international law action for recovery of property and in terms of the innovations in the field. I then proceeded to define the other legal means for the protection of rights in rem through a comparative analysis with action for recovery. The paper analyzes alike docrina controversial opinions about the topic and how it relates a personal point of view and argued in support of those considered most relevant.
