Farming as a subject of market land relations

Summary/Abstract: The article is devoted to the legal regime of agricultural land owned by citizens on the right of permanent use, the mechanism of its re-registration, the problems of lack of the right to inherit such land. The problems of organizational and legal character regarding the participation of farms in the purchase of agricultural land, which were revealed in connection with the adoption of amendments to Article 130 of the Land Code of Ukraine, are outlined. Farmers may be confronted with: 1) the lack of funds needed to buy back the parcels of land used by them for permanent use; 3) the land will be sold by the normative monetary assessment, not by the expert one, which is the most relevant and justified; land market owners will be willing to sell them. It should also be noted that if the rent is paid in advance, the farm as a legal entity automatically paid all the mandatory tax payments and fees for the entire period of the lease. It was emphasized that the right of redemption of the land used by the right of permanent use should be given both to the natural persons – founders and members of the farm, and the farm - the economic entity.
