Summary/Abstract: In all legal systems, originality is a condition for the protection of intellectual creations under copyright. Originality does not mean novelty; a work can be original even if it looks a lot like other works, as long as the similarity is random, not the result of copying. The originality of a work cannot be analysed according to predetermined and absolutely obligatory criteria, it must be investigated in each particular case separately, by reference to all the existing works in one field or another of creation. In this sense, the originality must be analysed according to the category of the created work (literary, scientific, dramatic, cinematic, and so on..)
