Summary/Abstract: The work is divided into two logical and connected entities: the rule of law and the position of courts in the institutional framework of the European Union. Author presents definitions of the rule of law from Serbian and comparative theory of the state and law (philosophy of law, and constitutional and administrative law). As with the internal legal order, the importance of the independence of the judiciary as a cornerstone of the rule of law has also been pointed out in the European Union. At the end of the article, the author raises the question of how much the courts of the European Union contributed not only to the improvement of the rule of law at the Union level, but also to the construction of its entire legal order.
