Summary/Abstract: This paper concerns a uniquely important subject in public procurement law, namely the understanding of ‘offer’ in the context of the respective provisions that regulate it. On the one hand, this issue warrants looking to an extra-statutory construction, i.e. Civil Code regulations. On the other, doubts arise about whether in light of public procurement regulations doing so is justified, especially as this discipline is autonomous in character. Particular provisions of public procurement law fail to disperse any doubts in that respect; therefore, taking this subject on appears cogent for practical reasons. It is topical not only from the point of view of the position of the contracting authority, but also the contractor.
