A dialogue between legal advisers on the legal adviser’s status

Summary/Abstract: The author of this article takes issue with the thesis put forth in the articles penned by Andrzej Kidyba and Jerzy Jacyszyn published in Radca Prawny vols. 1 and 2, in particular because they undermine the validity of considering legal advisers who practice their profession on the basis of employment contracts to be freelancers. Through an analysis of the content of indicated regulations of the Act on Legal Advisers, practices, judicial decisions, and legal commentary, the author points out the absence of subordination specific to the employment relationship regarding legal advisers and their professional duties. In addition, she presents the conditions that have determined the evolution and development of the profession of legal adviser and its adjustment to the needs of the state.
