The Legal Nature of the Irish Guarantee and Termination of the Lisbon Treaty Ratification of the President

Summary/Abstract: President of Czech Republic is wavering to sign the Lisbon Treaty. He gives several reasons that may enable to suspend his final signature. The paper answers the question if the Irish Guarantees are from the legal point of view the international treaty or not. The paper proves that the Decision of the Heads of States or Chiefs of Governments of the EU Member States is one type of international treaty. The substance of the treaty is more or less interpretative. This fact does not have any influence on the duty of the President to complete the ratification of the Lisbon Treaty immediately after the decision of the Constitutional Court is made.
