Summary/Abstract: This work is continuance of the same name article published in previous No. in this legal study. This 2nd part is the third chapter of the work dealing with distinctive criterions in Czech private law, and author tries to apply given criterions on Czech civil code. It is only outline, how it is possible to apply them. Starting point for this attempt is judicature of Czech’s courts and relevant literature into accounts. Author doesn´t enter into a debate with the opinions of the courts, because the aim of this part is help for ordinary practice. Author at the end makes some the most important marks about the practice of courts. Articles is systematized under the Czech civil code.
