Summary/Abstract: This article deals with the definition of wastein EC and Czech law. Waste is a key concept of the waste legislation. If the definition is too wide, recycling and the efficient use of objects and substances are difficult. On the contrary, a narrow definition leads to lower environmental protection, because many objects and substances are not treated as waste. The article is based on the analysis of the relevant decisions of the European Court of Justice. Author describes the definition of waste and the conditions, when the objects and substances are regarded as not being waste. Special attention is then given to the analysis of the By-products and End-of-waste status.
