Summary/Abstract: This study concerns itself with whether or not the invasion of Iraq by the U.S. was legal in terms of international public law. For that purpose, first the basics of international public law, like the sources and fundamental characteristics of it, will be shortly explained. Then, in particular, it will be discussed on the development of the prohibition in international law for waging war and the threat/use of force in international relations. The current system of international law of the United Nations allows use of force only in an act of legitimate defense against an occupying power and with an authorization by the United Nations Security Council to protect international peace and security. We apply for this view to the reasons for war mentioned by the U.S. as justifications for the invasion of Iraq and concludethat they are incompatible with international law.
