Summary/Abstract: The case of the termination of the individual labour contract by mutual agreement is stipulated within the provisions of article 55 letter b) from the Labour Code. Nevertheless, the Labour Code does not contain other provisions with respect to the conditions to be fulfilled in order to terminate the individual labour contract by mutual agreement, therefore the form or the nature of the document attesting the termination of the individual labour contract by mutual agreement are not regulated. With respect to the parties consent, the provisions of the Civil Code are applicable, based on the provisions of article 278 from the Labour Code, which stipulate the nature of common law of the civil legislation.
