Summary/Abstract: Controllers (art. 4 par. 7 GDPR) have the obligation to inform and notify in the event of a breach of art. 33, 34 GDPR. According to art. 33 GDPR, a violation of the protection of personal data must be reported to the responsible supervisory authority immediately after becoming known. The obligation to inform is not applicable in the event that the violation is not likely to endanger the rights and freedoms of individuals. On the other hand, if there is a high risk, data subjects must be informed without delay. The present article deals with some of the existing questions of interpretation, as they are discussed in Germany.
