Summary/Abstract: The study examines the issue of house arrest, from the point of view of the criminal law in force, as well as the relevant case law of the European Court of Human Rights, namely the problems encountered in the judicial practice, regarding the execution of this preventive measure in the real estate where the defendant lives and the permission to leave home. The study aims to analyze the institution in order to facilitate understanding and deepening it, as well as to support any necessary legislative changes.
