Summary/Abstract: The search for a balance between ensuring that the respect for fundamental rights and freedoms and the international security must not lead to divergence from the standards of protection of human rights that have already been achieved at national and international levels. The strife to ensure “own” safety may not lead to a significant lowering of standards of protection of the rights of the others in international relations; in other words, there is exceptional restraint in the use of force in international relations, and resorting to the instrument of humanitarian intervention. The struggle against the threats to international security must be conducted within the binding international law and national laws of individual states. The fight against unlawfulness must be conducted with the use of means conforming to law. This does not, however, mean that the international community and individual states weaken themselves in this way. By combating international threats, the state protects constitutional rights and the liberties of its citizens, yet only unless it does not limit of them excessively itself. There must be a certain balance maintained in both legislative and practical steps between answering the contemporary challenges to international security on the one hand, and citizen rights and liberties on the other.
