Summary/Abstract: Problems connected to the violation of human rights and civil liberties become the basic question in the democratic answer to terrorism. As a result of the reaction to the terrorist threat, democracy and human rights might be irreversibly harmed with too stringent moves of the states. What contributed to that was the atmosphere of fear following 11th September 2001, which resulted in the public opinion’s assent to passing anti-terrorist legislation limiting, if not downright violating, the principles of international humanitarian law and human rights. The political concept of “war on terror” was not connected with the construction of an appropriate legal system. As a result of copying norms from different fields of law, a conglomerate of elements borrowed from entire terrorist law and the law of military conflicts was developed. Fighting with the use of non-democratic, illegal methods and means may bring a victorious battle, yet a lost war against terrorism and in defence of human rights. Even the most powerful terrorist organisation does not pose such a great danger for human rights, as such reaction of the state to the threat of terrorism that limits citizens rights.
