Summary/Abstract: Both legislative delegation (regulated by Art. 115 of the Constitution) and the accountability of the Government (provided for in Art. 114 of the Constitution) are both procedures that allow the Government to tap into the sphere of enactment established by the Basic Law to the Parliament as the sole legislative authority of the country. Often, in practice, the Government has acted with abuse of power in using these procedures. We aimed in this article to clarify exactly the legal regime applicable to this case and to establish the distinction between the two procedures, through a comparative study, focusing also on some lex ferenda proposals.
