Summary/Abstract: Right to life is the most important human right, conditioning the existence of all the other rights. It is consecrated in numerous international instruments, the most important of them being the Universal Declaration of Human Rights and the European Convention on Human Rights. At national level, the Constitution guarantees the right to life, the right to physical and mental integrity.Acts of cruelty are factors which incompatibility with democratic society’s values is consecrated in national and international acts, generating vast jurisprudence.The Romanian Criminal Code regulates murder committed with cruelty as a circumstance of the qualified murder, subsequent to the pointing out of an increased and concrete social danger of the offense and a higher dangerous character of the perpetrator.
