Summary/Abstract: Religious education in public schools in post-communist Romania, under the influence of legal regulation has suffered significant changes. All these legislative changes represent serious efforts on behalf of society to regain not only by declaration, but in a very real and practical way, certain fundamental freedoms. Religious education itself has become a measuring stick of the democratization of romanian schools, a measure for the practical application of fundamental freedoms in the field of education. The purpose of this article is to offer a presentation of the primary offical documents establishing rules and regulations of the state, and the methods of teaching the scholastic discipline of Religion. A reflection upon the evolution of judicial regulation regarding religious education may lead to the identification of certain stages, of certain specific periods of time, marked in general by changes occuring within educational law. In taking this approach, it is hoped not just to give an inventary of judicial documents, but to provide an understanding of the philosophy in regard to freedom of thinking and religious education, but also the identification and awareness of the specific model used to implement religious education in Romania.
