Summary/Abstract: Entering into force of the new criminal law has created a confusion between the safety measure of the medical hospitalization under the conditions of art. 247 and 248 of the Criminal Procedure Code and the measure and case of referral to the competent court according to the special legal procedures in the matter of mental health for the non-voluntary hospitalization. The author explains the indifference between the two measures
