Summary/Abstract: Following the amendments given to the essential features of the offense, was also imposed a reorganization of the causes eliminating the criminal nature of the act of the old Criminal Code and turning them into causes supporting and non-attributable for those situations covered by criminal law, in the presence of which an offense committed and which complies with the standard of criminality, is permitted (lawful) or will not constitute an offense by the absence of the attributability of the person who committed it. We find such in the Criminal Code provisions, the institution of justifiable excess from the old regulation in the form of the excess of non-attributability – cause of non-attributability, regulated in article 26.
