Summary/Abstract: The new incrimination was introduced to make up for the ways of committing the offence of breach of trust. The offence of breach of trust by defrauding the creditors can be perpetrated in two variants which have been highlighted in recent years of case law, but legal authorities have not had available a legal text allowing the repression of such actions.
