Summary/Abstract: After the events that defined the Second World War and the Nazi regime, there was a movement to reject this regime and the laws enacted at the time. It was felt that laws passed by the Nazis lacked the character of legal rules because they were immoral. In law, the consequences were particularly important. German Basic Law (Grundgesetz) which came into force in 1949 marked a break with the tradition of legal positivism. In this study, we make an analysis of historical and comparative law perspective of a gripping problems by complexity, namely the constitutionality of values.
