Summary/Abstract: In this article we analyze comparative law in domestic legislation and that of other states regarding the summoning of the defendant at the hearing, the formal requirements for the summons, how to bring the knowledge of the procedural act recipient and conditions of the handing the summon to recipient, including treat these cases according to the judicial practice. Also will be revealed conditions established by law for the decision of the court to be tried in absentia, where the possibility of ruling in absentia and actions to be executed by the court for a decision on trial in absentia person.
