Summary/Abstract: The subject of the study is to present the evolution of the legal need to protect goods and interests remaining after the partition of the Poland. The necessity of such protection appeared even in the pre-partition period. However, the specific form of institutional protection of Polish goods and interests, for the first time, took place in the Duchy of Warsaw, and then in 1816, in the Kingdom of Poland. The aim of this study is to demonstrate the positivist work of the Polish elite to protect what remains aft er the partitions with the hope of building a material foundation for an independent homeland. The author does not undertake an in-depth discussion on the status of the Kingdom of Poland. The work is based mainly on the analysis of the constitution of the Kingdom of Poland of 1815 and the decision of the Tsar of Russia of 1816 to establish the General Counsel’s Office. In addition, the views of the doctrine on the subject were referred to. As a final conclusion, we should point to the statement of the positive role played by the General Counsel’s Office of the Kingdom of Poland
