Summary/Abstract: The study is based on unedited documents from the 18th century, and especially on the examination of witnesses during the inquiries of 1738 and 1776-1777, determined by the complaints exposed to the Habsburg imperial fora by the Romanian sheperds’ village of Rășinari and unfolded by the Transylvanian Gubernium in the Romanian pastoral area of Mărginimea Sibiului. These documents are included in the volume entitled Transmissionales in causa Possesionis Resinar contra Liberam Regiamque Civitatem Cibiniensem 1784. This study also analyses elements of the Romanian consuetudinary law or customary law (Jus Valachicum and Mores Valachicales), as the persistance of the Romanian institutions of Jus Valachicum on the Saxon Land (Fundus Regius) during the 18 th century in Transylvania. The justice and trials of the village Rășinari (judicatus pagi Rasinar, judicatus pagensis) were exerted by the community’s representatives, namely by the judge (judex), the jurries (jurati) and the Council of 40 Old Men (quadraginta seniorum viratus).
