Some considerations on the decisions of the Constitutional Court regarding the prescription of criminal liability

Summary/Abstract: The article is an analysis starting from the fact that the decisions of the Constitutional Court produce effects for the future (ex nunc), in the sense that they do not produce, as a rule, direct effects, being necessary to agree the normative act with the Constitution, by the initiator legislative, the effect of ceasing the effects of the unconstitutional provision being a sanction for its passivity, as well as in the sense that normative acts or their provisions can be declared unconstitutional.
