Summary/Abstract: The author of this paper analyzes the legal norms regarding the marriage in different countries, the applicable international private law and the conflicts of laws when the parties are from different countries or have same sex. Nowadays, thanks to the migration opportunities, most of the couples are from different countries and the fact thatpeople have more and more rights and freedoms, several countries accept the same-sex official couples. Theproblem appears once the couples have children or return to the country of origin, where the marital status is nolonger recognized. Then the conflicts of laws must be carefully analyzed, and decisions should be taken in the bestinterest and safety in order to protect the families. During the research were discovered several families still waitingfor their situation to be clarified and a lot of folders still open on the tables of several Courts. The author alsoanalyzes the conflicts of laws during the history of the Romanian legislation.
